These terms govern your use of https://xpansionit.com and any engagement you enter into with XpansionIT for software development, consulting, or related services.

Effective: Q1 - please replace before launch

1. Acceptance

By browsing this website or engaging XpansionIT, you agree to these terms. If you do not agree, please stop using the website and contact us before signing any engagement agreement.

2. Use of this website

This site is provided to share what we do and how to reach us. You may:

  • Read, link to, and share any of the public content on this site.
  • Use the contact form to send us a project brief or general enquiry.
  • Apply to open roles listed on our careers page.

You agree not to:

3. Engagement agreements

The work XpansionIT does for clients is governed by a separate written agreement signed by both parties. That agreement always takes precedence over the general statements on this website. Pricing, scope, milestones, intellectual property, and confidentiality are all addressed in the engagement agreement, not here.

4. Intellectual property

Unless your engagement agreement says otherwise, you own the work product XpansionIT delivers for you, including the source code and documentation, on the day of final acceptance. XpansionIT retains ownership of the components, libraries, and patterns we bring in from previous work.

Trade marks, the XpansionIT brand name, and the visual identity on this website remain owned by XpansionIT.

5. Confidentiality

Material you share with us when briefing a project is treated as confidential. We do not share client information with third parties without written consent, and we will sign a mutual non-disclosure agreement on request before any detailed technical conversation.

6. Third-party links and tools

This site may link to third-party websites, calendars, or repositories. We choose those services carefully but do not control them, and the terms of those services apply when you use them.

7. Limitation of liability

To the maximum extent permitted by Australian law, XpansionIT is not liable for any indirect, incidental, or consequential loss arising from your use of this website. Limitations specific to delivered engagements are addressed in the engagement agreement.

8. Governing law

These terms are governed by the laws of South Australia, Australia. Disputes will be addressed in the courts of South Australia, except where a different jurisdiction is required by your engagement agreement.

9. Changes to these terms

We may update these terms from time to time. Material changes will be flagged on the page header. Continued use of the website after a change indicates acceptance of the updated terms.
